This Privacy Statement applies to persons interested in Mercedes-Benz Classic who are looking for personal information relating to classic Mercedes-Benz vehicles, such as products and divisions, a history of vehicle classes, services and offers, or who wish to schedule a personal consultation, as well as for contracts that make express reference to this Privacy Statement.

Protecting your personal data is our top priority and is taken into account for all our business processes. The Privacy Statement below provides you with a detailed overview of how your personal data is processed by Mercedes-Benz AG along with your request for personal assistance, contact or a consultation or informational meeting. "Personal data" means all information that relates to a natural person who has been or can be identified. With this privacy statement, we are informing you of the type, scope and purpose for which we collect your personal data as well as how we handle that data. You will also learn what rights you are entitled to regarding the processing of your personal data.

We process personal data („Data“) under the principles of data reduction and data minimization only to the extent necessary, as permitted due to applicable legal regulations, according to our obligations, or if you have granted your consent.
Unless otherwise set forth below, the terms "process" and "processing" include, but are not limited to, the collection, use, disclosure and transfer of personal data (see Article 4, para. 2 of the EU's General Data Protection Regulation (GDPR)).

Data related to your inquiry
In relation to your inquiry about classic Mercedes-Benz vehicles, a personal consultation, or other requests for information, we collect data if doing so is required to fulfill our contractual obligations to you or you have granted your consent. This includes, but is not limited to:

•    Master data of the interested party, particularly the name and, if requested,
   current address and date of birth.
•    Contact data of the interested party, particularly the e-mail address and, if requested,
  telephone number and current address.
•    Any other data requested on the application form.

If we use the tracking tools of a service provider to record your activities for statistical purposes on the Mercedes-Benz Group website, your data will be processed only after anonymizing it – for example, by abbreviating the IP address.
With regard to your inquiry, we will also collect and process certain additional data required to fulfill our contractual obligations to you. This includes, but is not limited to:

•    Data from correspondence (postal and electronic) between you and us.
•    Data from other postal, electronic or telephonic communication.

Data from other sources
If needed to fulfill the contract concluded with you, to perform pre-contractual measures, or if you have consented, we also process the personal data that we receive in a lawful manner from affiliated companies of Mercedes-Benz AG and other third parties.
We will process personal data from public sources (such as authorities, the Internet) only where permitted by law – such as if we must do so to provide or services or if you have consented.

Collection and processing to fulfill legal obligations
We collect and process your personal data (set forth in more detail in Section 3) as part of the initiation of a contractual relationship and to fulfill our contractual obligations to you (Article 6 para. 1b) GDPR). For example, we process your contact information for your inquiry in order to fulfill your request that we contact you personally or that we provide you with certain information.

Processing based on legitimate interest
Furthermore, we process your personal data provided this is necessary to protect the legitimate interests of Mercedes-Benz AG or a third party (Article 6 para. 1f) GDPR). This is the case particularly if so required in order to assert legal claims or defend against legal disputes.
We can process your data in anonymized form to further develop our services and products as well as for statistical purposes.

Collection and processing based on your consent
Your personal data will also be collected and processed if you have previously agreed (consented) to this (Article 6, para. 1a, GDPR).

We will not share your personal data with third parties unless you have consented to the sharing of your data, there is a legitimate interest of Mercedes-Benz AG or a third party in the sharing of your data, or we are entitled to or obligated to share the data under legal provisions and/or official or court order

Data sharing with processors on our behalf
We engage external data processors (e.g. IT service providers) in order to perform our services. The disclosure of your data to these organizations by Mercedes-Benz AG takes place under strict confidentiality obligations and under the criteria of the GDPR and the German Federal Data Protection Act. The data processors commissioned by us, who may only process the data for us and not for their own purposes, are obligated to comply with the strict standards of Mercedes-Benz AG.

Data transmission to Mercedes-Benz Museum GmbH
In special cases, we may transmit your data, if needed, to Mercedes-Benz Museum GmbH to resolve your issue in an efficient and effective manner.

Data will not be transmitted to countries outside the EU or EEA ("third countries") unless we are obligated to do so by official order or court order. .

No automated decision-making takes place as defined in Article 22 of the GDPR.

We process and store your personal data only as long as needed in order to fulfill contractual or legal obligations. Once the legitimate interest no longer applies, we will delete the data or, if that is not possible, we will block it. As a rule, we delete your contract data no later than ten years after the end of the contract relationship.

You have extensive rights regarding the processing of your personal data. Making you aware of these rights is very important to us:

A.   Right of access: You have a right to information regarding the data stored with us, especially for the purpose of the processing and the duration of the data storage (Article 15 GDPR).

B.   Right to rectification of inaccurate data: You have a right to demand from us the immediate correction of your personal data, should it be inaccurate (Article 16 GDPR).

C.   Right to erasure: You have the right to demand that we erase your personal data. The criteria allow you to demand the deletion of your personal data if, for instance, we no longer need the personal data for the purposes for which it was collected or otherwise processed, if we unlawfully process the data, or if you have rightfully objected to the use of your data, revoked your consent to the same or there is a legal obligation to delete (Article 17 GDPR).

D.   Right to restriction of processing: You have the right to demand a restriction of the processing of your data. This right especially applies for the duration of the review if you have disputed the accuracy of your personal data, as well as in the case that, for an existing right to deletion, you request restricted processing instead of erasure. Furthermore, there will be restricted processing if the data is no longer required for our purposes, but you still need the data in order to assert, exercise or defend legal rights, as well as if the successful assertion of an objection is in dispute between you and us (Article 18 GDPR).

E.   Right to data portability: You have the right to receive the personal data you have provided us with in a structured, common, machine-readable format from us (Article 20 GDPR), provided said data has not already been deleted.

You can withdraw consent to the processing of your personal data at any time, with future effect and free of charge. This also applies to declarations of consent that were issued before the EU General Data Protection Regulation took effect – that is, before May 25, 2018.

Please note that the withdrawal of consent is only effective for the future. Any processing carried out before the withdrawal is not affected by this. By withdrawing your consent and preventing us from processing your data, we may no longer be able to provide our services in whole or in part and, therefore, may be obligated to terminate the existing contract. .

You have the right to object at any time to the processing of personal data about you (Article 21 GDPR) for reasons arising from your specific situation. We will no longer process your personal data unless we can prove compulsory, legitimate reasons for processing that outweigh your interests, rights and freedoms, or if the processing is required to assert, exercise or defend against legal claims.
